Nike and Apple Agree to Settle FuelBand Class Action Suit

Nike_FuelBand_SEWe got an apparently legit e-mail this evening informing us that we were entitled to a $25 Nike gift card as a settlement in a class action suit against Nike and Apple. Say what?

It turns out that a) there was such a suit, alleging that the companies knowingly made false claims about the health benefits of the FuelBand, and b) the companies are settling it. Anyone who bought a FuelBand between Jan. 19, 2012 and June 17, 2015 is entitled to either $15 cash or a $25 Nike gift card. Nike’s on the hook for $2.4 million. Apple has no financial responsibility in this case, so no iTunes cards.

Plaintiffs claim that the FuelBand couldn’t live up to claims of calorie tracking, steps, and overall activity represented by “NikeFuel;” that Nike knew it; and that Nike continued to sell the FuelBand anyway.
